  Different forms of IPR  
  The Trade Related Aspects of Intellectual Property Rights (TRIPS) in the agreement of
World Trade Organisation(WTO) recognizes seven forms of IPR, namely Patents, designs, trademarks / service marks, copyrights, geographical indications, integrated circuits and trade secrets.
 
     
 
 
Filing requirements for documentation
 

Patents

  • Full names, age, Father’s name and addresses of Applicant as well as Inventor.
  • Power of Attorney (neither notarization nor consular legalization required) to be executed by an individual or a representative of a corporation.
  • Specifications of Invention including claims and abstract Drawings-prepared in triplicate(A4 size)
  • Full detail of the Invention including  title, historical background, claims and Drawings ,if any
  • Official fees & professional charges.

Trademark

  • Full name, address and nationality of Applicant.
  • Nature of business of the entity
  • Date of first use of the mark in India ( Prior use is not necessary to file an application.)
  • Specification of goods or services specified in terms of individual names.
  • Specimen of the Mark- logo, label, slogan etc.
  • Details of Convention Priority, if any- first filed country, filing number and date; the term of priority is six(6) months.
  • Power of Attorney-TM-48 (neither notarization nor consular legalization required) to be executed by an individual or a representative of a corporation.
  • Certified copy of the application which is the basis of the Convention priority (if applicable)
  • A clear print of the mark or 15 prints of color mark (not larger than 9cm x 7cm) or send mark as email attachment
  • Official fees & professional charges.

Design

  • Full names, father’s name, nationality and addresses of Applicant as well as Designer
  • Title/Name of Article to which a design is applied
  • Details of Convention Priority, if any- first filed country, filing number and date; the term of priority is six (6) months.
  • Power of Attorney (neither notarization nor consular legalization required) to be executed by an individual or a representative of a corporation.
  • Certified copy of the application 20 which is the basis of the Convention priority (if applicable)
    Drawings / Photographs
  • Perspective view in addition to six directional views (front, rear, right side, left side, upper and bottom views). Photographs are acceptable
  • Shadings are not allowed unless it is very necessary.
  • Official fees & Professional charges for filing application.

Copyright

  • Name, Age, Father’s name, address and nationality of the Application
  • Nature of the Applicant's interest in the copyright of the work
  • Language of the Work
  • Description of the work
  • Title of the work.
  • Power of Attorney (neither notarization nor consular legalization required) to be executed by an individual or a representative of a corporation
  • Four copies of the work
  • Official fees & Professional charges
