  Registration of IP Rights with Indian Customs  
 

As per THE INTELLECTUAL PROPERTY RIGHTS (IMPORTED GOODS) ENFORCEMENT RULES, 2007 a rightful owner of intellectual property is entitled to apply to Customs Authority for restricting entry of counterfeiting or infringing goods into the territory of India by way of recording and registering their IP rights with the Indian Customs.

Entire process of registration would normally take around 30 working days. Minimum validity period is 1 year unless the owner applies for a shorter period of time for customs assistance or action. The right could be valid until 5 years from the date of registration. Fresh application has to be made thereafter.

Procedure is simple, less expensive, fast and could help in averting unnecessary litigations
